By accessing and using The Mad Space, you accept and agree to be bound by the terms and provisions of this Agreement.
1. Acceptance of Terms
By accessing our site and placing an order, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Eligibility
You must be at least 13 years old to use this Service. If you are under 18, you must have parental consent.
3. Account Registration
You agree to provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and notifying us immediately of any unauthorized access.
4. Creator Program
Creators earn commission through our tiered system: Concept Submitters earn 10-20% of profit, Creator Submitters earn 25-35% of profit per sale, based on lifetime sales volume. Founding Creators are locked at 35% for life. Minimum payout $25 CAD, sent by PayPal or bank transfer.
5. Orders & Payments
All orders are subject to availability and price confirmation. Payments are processed securely via Stripe. We accept Visa, Mastercard, American Express, Apple Pay, and Google Pay. Orders may be cancelled within 24 hours of placement.
6. Shipping
We ship to Canada and the United States only. Processing time is 3-5 business days for printing, plus 5-10 business days for delivery. Free shipping on orders over $100 CAD.
7. Returns & Refunds
You have 30 days to return unworn items in original packaging for a full refund. Defective products will be replaced at no cost. Custom items may be subject to different terms.
8. Intellectual Property
All designs on the site belong to their respective creators. Unauthorized reproduction is strictly prohibited. Our branding and content are property of The Mad Space.
9. Prohibited Activities
You may not submit content you do not own, use the Service for illegal purposes, attempt to hack or disrupt the Service, or harass other users.
10. Disclaimers
THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. We do not guarantee continuous, uninterrupted access or error-free operation.
11. Limitation of Liability
The Mad Space shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the last 12 months.
12. Governing Law
These Terms are governed by the laws of Canada and the province of Ontario. Quebec consumers may rely on the mandatory protections of the Quebec Consumer Protection Act (CQLR c P-40.1) regardless of this governing law clause. Any disputes shall be resolved through binding arbitration in Ontario, Canada, or the courts of competent jurisdiction in Quebec for QC consumers.
